Terms and Conditions


TERMS :  
Launching requires account to be paid in full. 
Signed original agreement must be returned before boat arrives for Haul-Out, Storage orDockage.
Uncontracted services and/or storage charges may be assessed at a higher rate.
Winter storage must be paid within 30 days after hauling or upon arrival for wet storage. 
A deposit of 25% of the summer slip fee must be remitted on or before November 15. The balance is due on or before March 1. The slip deposit is refundable thru March 1.
Interest @ 1 ½ % per month on the unpaid balance will be added to all accounts.
There shall be a charge of $ 25.00 for checks returned to us unpaid.
Cost of collection, including reasonable attorney's fees, shall be born by the boat owner.
Failure to receive an invoice does not invalidate the above terms.

LAUNCHING / HAULING
Actual launching dates will be dependent upon weather, physical location of the boat and previously scheduled work. One-week notice is required for launch or haul.
Boats launched after June 1 will be assessed a fee, pro-rated, as per current rate schedule. 
Boats hauled after November 30 will be assessed a surcharge of 10% on all winter storage related charges.

GENERAL RULES :
Owners who store their boats with the mast up shall maintain proper liability insurance.
Moving of boat stands by boat owner is done at own risk. Boat covers shall not be tied to boat stands.
When a Winter Storage boat is launched that does not have Summer Dockage here, two (2) days' dockage will be provided without charge. Additional days of dockage, if available, will be charged @ $ 2.50/ft/day.
Short Haul boats are expected to depart on day of launch. Dockage, if available, will be charged @ $2.50/ft/day. 
Wet Storage boats arriving before November 15 and/or leaving after April 30 will be charged on an individual basis.
If ownership of boat is changed, all bills, if any, shall be paid in full before the boat leaves the yard.
All owners are required to keep area around boat clean and free of any rubbish and a dumpster is provided for this purpose.
Owners are responsible for cleaning up cradle area prior to launch.
Only boats with current registration stickers can be launched.
Outside vendors are required to provide the Yard with a certificate of insurance prior to commencing any work on any boat.
Welding and Sandblasting must be approved by the management.
Assignment of slips will be done at the discretion of the management.
Heads are to be sealed when at the dock; please use shore facilities, this is a State requirement.
No fires on docks or on boats. Gas grills etc. may be used ashore with proper safety precautions.
Water outlets and/or facilities will be available weather permitting.
No heaters to be used when no one is aboard.
Pets must be on a leash at all times.     
All work performed by Yard personnel must have a work order signed by the boat owner.
All labor is computed at $ 60.00 per hour.
A surcharge of $ 150.00 will be assessed for work performed on weekends and holidays.
Permitted Live Aboard's shall be assessed a monthly surcharge as well as for utilities & other services on an individual basis.
A $ 150.00 fee will be assessed on all trailers stored here for the summer months.
A $ 100.00 fee will be assessed on all cradles and/or boat stands stored here for boats that do not return for winter storage. 

The Management reserves the right to cancel any slip rental agreement with one week notice (2 hours notice for transient dockage rental agreements)  if in its view the behavior of the owners or their guests is incompatible with the yard; refunds will be pro-rated.

RESPONSIBILITY :
The grant of any storage space and launching service, mooring, slip or dock space, tie-up privilege, towing, hauling, or moving, afloat or ashore, or any service whatsoever granted by the Yard will be accepted with the distinct understanding, and the owner hereby agrees, that neither the Yard nor any of its owners, directors, officers, employees or agents assume any responsibility whatsoever for the safety of any boat at the boatyard either ashore or moored in the boat basin or adjoining waters, and none of them shall be liable to the owner or any person claiming by, through or under him for fire, theft, or loss of use (and/or revenue for commercial vessels) or any damage whatsoever to any such invitees, however caused and whether or not caused by the default or negligence of the Yard or any of its owners, directors, officers, employees or agent.  In addition the owner does hereby indemnify and hold harmless the Yard and its owners, directors, officers, employees and agents of and from any and all liability, claims and demand for damage to the property of, injuries to, other property damage or lose of use (and/or revenue for commercial vessels) and personal injuries caused by the owner, his family, employees, guests or invitees. The owner agrees that any grant of storage space and launching service shall constitute a rental space only and no bailment of any kind is intended or created either express or implied. The owner further agrees that all risk of loss, damage or destruction of said vessel, its equipment, or other property of the owner shall at all times be born by the owner.
No terms or conditions herein may be changed or modified unless in writing, signed by the parties.
